Annex - Interim Guidelines for The Application of The NOx Technical Code

  1 Each engine which will become, retrospectively, subject to the provisions of regulation 13 of Annex VI of MARPOL 73/78 upon its entry into force, should be certified in accordance with the requirements of the NOx Technical Code.

  2 Pending entry into force of Annex VI and upon satisfactory compliance with the Code requirements, a "Statement of Compliance" with the NOx Technical Code should be issued by the flag State Administration, or an organization acting on behalf of that Administration. Such a Statement of Compliance should contain as a minimum the information as required by appendix 1 of the NOx Technical Code.

  3 The Statement of Compliance is intended as an interim measure pending issuance of the Engine International Air Pollution Prevention (EIAPP) and/or International Air Pollution Prevention (IAPP) Certificate upon entry into force of Annex VI.

  4 Administrations are urged to take into consideration the Statement of Compliance when issuing certificates in accordance with Annex VI, whether or not the Statement of Compliance was issued by their Administration, or organizations acting on their behalf, or by other Governments.
